- Key Terms
Customer: Any individual or entity who enters into a transaction of sale, purchase, or storage of a Product(s) with Nawal Jewellery Trading LLC.
Customer Service: The service in charge of handling Nawal Jewellery Trading LLC’s customers.
Nawal Jewellery Trading LLC: A company registered in the United Arab Emirates.
GTC: General Terms and Conditions of sale of Nawal Jewellery Trading LLC.
Order(s): All orders, including sale orders and purchase orders.
Order Confirmation: The order confirmation sent by email to the Customer and/or via the Customer account.
Order Date: The date on which the Order is placed by the Customer.
Person of Contact: The individual person indicated by the Customer if the Customer is no longer reachable.
Product(s): Each and all products offered on Nawal Jewellery Trading LLC’sWebsite, such as gold, legal tenders, minted coins, minted bars.
Storage: The storage of precious metals products bought on Nawal Jewellery Trading LLC and directly stored in Nawal Jewellery Trading LLC’s vaults.
Website: The website www.nawal.com.
Working Days: The days of the week, excluding weekends and public holidays officially recognized by the legislation applicable to Nawal Jewellery Trading LLC.
- Extent and Contractual Entities
2.1 By accessing and using the Website, App, and other services offered by Nawal Jewellery Trading LLC —including placing purchase Orders (refer to Article 5), sale Orders (refer to Article 10), or storing Products in Nawal Jewellery Trading LLC vaults—the Customer agrees to be bound by these General Terms and Conditions (GTC). Any written documents or specific conditions presented by the Customer that deviate from or conflict with these GTC will not take precedence over them unless Nawal Jewellery Trading LLC has expressly consented in writing to such deviations. These terms govern all Orders, sales, purchases, and the Storage of Products, irrespective of whether transactions are conducted via the Website, App, telephone, or any other method.
2.2 The Customer must be at least 18 years old, capable of discernment, and not under any form of curatorship to place an Order through the Website, which they confirm when opening an account, placing purchase Order(s), sale Orders with Nawal Jewellery Trading LLC, or storing Products in Nawal Jewellery Trading LLC vaults. Each Customer is only allowed to open one (1) account under his/her or any other name with Nawal Jewellery Trading LLC.
- Investment Risks and Advisory Information
3.1 The price of Product(s) sold by Nawal Jewellery Trading LLC depends on the fluctuations of the financial markets.
3.2 All investments involve some level of risk. If the Customer is considering purchasing precious metals as an investment, he/she should assess the current market and consult with his/her financial advisor for any advice. The Customer agrees that Nawal Jewellery Trading LLC does not provide any advice on the opportunity to invest in, disinvest from, or remain invested in, a particular precious metal.
3.3 The Customer further agrees that any transaction made with Nawal Jewellery Trading LLC and/or Order(s) placed on this Website or Application is at his/her own risk.
- Website/Application Information and Shipping Costs
4.1 Although Nawal Jewellery Trading LLC strives to inform Customers in the most complete and diligent manner possible, the photos, videos, and texts illustrating and describing the Products, as well as the state of the stocks mentioned on the Website, Application are not contractual and are provided for information only.
4.2 The prices shown on the Website are denominated in U.S. dollars ($), and UAE Dirhams (AED). They do not include tax, shipping, payment, and other costs.
4.3 Shipping fees are calculated and are payable per Order, where consolidated dispatch of multiple Orders as a single unit is not possible for technical reasons. Nawal Jewellery Trading LLC ensures all of its Order(s) shipments to the Customer for the sale price of the enclosed Product purchased from Nawal Jewellery Trading LLC or, for Product(s) stored with Nawal Jewellery Trading LLC, for the metal value at the moment the delivery is requested.
4.4 The Customer acknowledges that without limiting any of the foregoing, the Products and the services provided by Nawal Jewellery Trading LLC and their respective information, pricing and data, and availability are subject at any time and from time to time to human, mechanical, typographic, or other errors, oversights, mistakes, limitations, delays, service interruptions, including, without limitation, those which may be due in whole or in part to, related to or arising out of Nawal Jewellery Trading LLC or its providers’ computer hardware and software, telecommunication and operating systems, databases, or business processes and procedures, as well as other problems inherent in, or which may be associated with, the use of the internet and electronic communications including, without limitation, force majeure events, as well as government, regulatory, and acts and omissions of third parties affecting or impacting the Products and the services provided by Nawal Jewellery Trading LLC, its information and data, or such communications. Consequently, the Customer will not hold Nawal Jewellery Trading LLC responsible and/or liable in any way whatsoever for any delays, failure, or other loss due to, caused by, or resulting from any of the problems described above, in whole or in part.
4.5 All copyrights, trademarks, and other intellectual property rights on the Nawal Jewellery Trading LLC Website and any web pages, documents, advertising, or any additional support shall remain at all times the sole and exclusive property of Nawal Jewellery Trading LLC or the third-party owners. The Customer shall have no right or interest in such intellectual property rights except for the non-exclusive right to access and use them as specified under this or any other agreement with Nawal Jewellery Trading LLC The Customer shall not copy, modify, decompile, reverse engineer, alter, or make derivative works of Nawal Jewellery Trading LLC intellectual property rights or how they operate unless under the express agreement of Nawal Jewellery Trading LLC.
- Placing an Order with Nawal Jewellery Trading LLC
5.1 Nawal Jewellery Trading LLC presentation of Products on the Website and App does not constitute a binding offer but is merely an invitation for the Customer to engage with Nawal Jewellery Trading LLC.
5.2 By clicking on the “Confirm Order” button, the Customer makes a binding offer to Nawal Jewellery Trading LLC to purchase the Product(s) concerned at the price indicated on the Website. The Customer will then receive an automatic Order Confirmation from Nawal Jewellery Trading LLC
5.3 Before clicking on the “Confirm Order” button, the Customer can view and modify his/her Order directly in his/her Cart.
5.4 The Order Confirmation constitutes the acceptance of the Order by Nawal Jewellery Trading LLC and forms a binding contract between Nawal Jewellery Trading LLC and the Customer.
5.5 Important Notice: Once the Order Confirmation has been sent, the Customer cannot cancel or withdraw from his/her Order.
5.6 Execution of the sale by Nawal Jewellery Trading LLC and the Product’s shipping or Storage is expressly subject to the reception by Nawal Jewellery Trading LLC of the full payment of the total price of the Order.
5.7 NAWAL reserves the right to refuse, cancel, and terminate Order(s)/contract(s) at any moment before delivery and at its sole reasonable discretion (mainly but not limited to non-payment in whole or in part by the Customer) without any responsibility towards the Customer.
5.8 Cancellation of Order(s) by Nawal Jewellery Trading LLC is subject to Nawal Jewellery Trading LLC market loss policy (see article 12 below).
5.9 Important Notice: Default by the Customer on payment of his/her Order(s)/Product(s) is subject to Nawal Jewellery Trading LLC market loss policy (see article 12 below).
5.10 Discount codes can only be used during the Order process on the Website and App. Each discount is identified by a discount code and has different requirements and rewards. All requirements stated on the discount code must be met to receive the discount. Each discount code is valid for a limited time only.
5.11 Discount codes cannot be replaced if lost or deleted by the Customer. A discount code will be considered used once the Order is placed, even if this Order is then canceled. Discount codes are not transferable or redeemable for cash and cannot be combined with any other coupons or any other offer. Only one discount code is allowed per Order. Nawal Jewellery Trading LLC reserves the right to discontinue a discount code at any time.
- Financial Settlement and Retention of Ownership
6.1 Nawal Jewellery Trading LLC currently accepts payments for Orders in UAE Dirhams (AED) only. The Customer can pay via PayTabs or Apple Pay.
6.2 After placing an Order, the Customer will receive an invoice from Nawal Jewellery Trading LLC indicating the total amount paid for the Order.
6.3 When placing their first order with the Auto-Savings feature, the Customer agrees that their chosen payment method will be used to settle this and all subsequent Auto-Savings orders.
- Liability Transfer, Shipping Procedures, and Tax Responsibilities
7.1 All Product(s) shipped by Nawal Jewellery Trading LLC are insured during their delivery. The risk transfers to the Customer as soon as the delivery is deemed complete.
7.2 All Product(s) are shipped by Nawal Jewellery Trading LLC, at its discretion, by Cash trans Money And Valuables Transport Services LLC recognized carrier.
7.3 Products bought as part of an Auto-Savings plan are for Storage only and cannot be shipped.
7.4 In the event the Customer selects the “Shipping” option, delivery of the Product(s) shall occur at the agreed-upon address.
7.5 The delivery shall be deemed completed when the Product(s) has been handed over at the given address or pick-up location to a person indicating or claiming to be authorized. This person can be asked to prove his/her identity. Delivery to a mailbox, deposit box, etc., is not allowed and will not be insured.
7.6 If, for any reason beyond its control, Nawal Jewellery Trading LLC fails to deliver the Product(s), it may cancel the contract, and, subject to Nawal Jewellery Trading LLC market loss policy (please see article 12), any payments made will be refunded to the Customer. Nawal Jewellery Trading LLC’s rights, and particularly any additional expenses, remain unaffected.
7.7 Transport/shipping costs, taxes, and risks inherent to the return of Product(s) (including if the carrier does not fill a calling card) for a reason attributable to the Customer (including but not limited to unclaimed Product, inaccurate or incomplete delivery address, etc.) and/or to a possible reshipment are for the account of the Customer exclusively, as are the risks of storing the merchandise returned.
7.8 Nawal Jewellery Trading LLC will not reship any Order unless and until it is paid in full for any return shipping costs, duties, taxes it has had to pay or advanced for the Customer, as well as any subsequent fees to ship the Product back to the Customer.
7.9 For insurance purposes, delivery of Products exceeding five hundred thousand Dirhams (AED 500,000.00) in total value if the Order contains individual products valued above AED 250,000.00 will be split into several packages. For these Products, Nawal Jewellery Trading LLC will use a dedicated shipping service.
7.10 The Customer may be subject to taxes and/or duties for his/her delivery Order(s) of Product(s) from Nawal Jewellery Trading LLC.
7.11 The Customer shall consult his/her local customs for more information on duty and tax rates. Nawal Jewellery Trading LLC always declares the full value of the shipment on any customs form. There are no exceptions to this rule.
7.12 All duties and taxes must be paid by the Customer at the latest on delivery of the Product(s). Nawal Jewellery Trading LLC shall not be held responsible for the payment of any duties and taxes that are the Customer’s exclusive responsibility.
7.13 Important Notice: The Customer must refuse any shipment that appears to be damaged or tampered with, as the shipping insurance ends once the delivery is deemed complete. When refused, the package(s) will return to Nawal Jewellery Trading LLC for inspection. Customers must immediately submit a complaint by email to the Nawal Jewellery Trading LLC Customer Service to preserve any associated rights against the shipper/carrier. In the event of a loss, the Customer has the obligation to contact Nawal Jewellery Trading LLC two (2) business days from the last scan of the package to report the loss. Losses reported after 2 days will, unfortunately, be rejected.
7.14 If there is any disruption in the delivery of Product(s), the Customer agrees to cooperate with Nawal Jewellery Trading LLC in any investigation or claim process and to take every reasonable action requested of him/her in the process. Failure to fully cooperate will jeopardize coverage that may be provided to the Customer.
- Vault Storage Services Provided by Nawal Jewellery Trading LLC
8.1 Nawal Jewellery Trading LLC guarantees that Product(s) owned by the Customer are physically stored in Nawal Jewellery Trading LLC’s dedicated and segregated vaults. The Customer retains the full title of his/her Products stored with Nawal Jewellery Trading LLC.
8.2 Nawal Jewellery Trading LLC is a private company with all its assets held outside of the banking system. When stored in the secure locations operated by Nawal Jewellery Trading LLC service provider, Product(s) are insured based on current market values and protected against physical loss, theft, and/or damage.
8.3 Through his/her personal online Nawal Jewellery Trading LLC account, the Customer can request the delivery of his/her Product(s), or sell to Nawal Jewellery Trading LLC all or some of his/her Product(s), at any time. The Customer has online access to his/her account that shows the status of his/her Product(s).
8.4 When the Customer wishes to ship Product(s) held in Storage, he/she is subject to the shipping costs in effect. All costs related to the shipping of the stored Products, duties, and/or taxes are exclusively for the account of the Customer.
8.5 The products purchased and stored with Nawal Jewellery Trading LLC are VAT-free.
8.6 Nawal Jewellery Trading LLC shall not deliver stored Product(s) to the Customer until the reception of the shipping costs.
8.7 Important Notice: A Customer account will be considered inactive after presenting no login attempts from the Customer for a period exceeding one (1) year from the last login, and after significant yet unsuccessful attempts to reach the Customer and/or Person of Contact. In the event of a customer account with existing Stored Product(s) becoming inactive, Nawal Jewellery Trading LLC reserves the right to sell the Product(s), charging administrative fees of one thousand three hundred UAE Dirhams (AED 1300.00), at the Customer’s risk. Within 360 days from the sale, the Customer and/or Person of Contact shall be entitled to request the reimbursement of the net result of the sale. Nawal Jewellery Trading LLC’s rights, and particularly any offset rights, remain unaffected.
- Limitation of Liability
9.1 Nawal Jewellery Trading LLC is not liable for any loss, damage, or delay caused by events beyond its control, including but not limited to acts of God, war, terrorism, strikes, or technical failures.
9.2 Nawal Jewellery Trading LLC is not responsible for losses due to the Customer’s failure to comply with these GTC or other instructions provided by Nawal Jewellery Trading LLC.
9.3 Under no circumstances shall Nawal Jewellery Trading LLC be held liable for indirect, incidental, or consequential damages resulting from the use of its services or products
- Intellectual Property
10.1 All intellectual property rights, including trademarks, logos, designs, and content on Nawal Jewellery Trading LLC’s Website or App, are owned by Nawal Jewellery Trading LLC or its licensors.
10.2 The Customer is prohibited from copying, reproducing, or distributing any materials from the Website or App without prior written consent from Nawal Jewellery Trading LLC.
10.3 Unauthorized use of Nawal Jewellery Trading LLC’s intellectual property may result in legal action.
- Termination
11.1 Nawal Jewellery Trading LLC reserves the right to terminate or suspend any Customer account if the Customer violates these GTC or engages in fraudulent activities.
11.2 Upon termination, any pending transactions or orders will be reviewed and processed at Nawal Jewellery Trading LLC’s discretion.
11.3 The Customer may terminate their account at any time by notifying Nawal Jewellery Trading LLC, subject to outstanding obligations being fulfilled.
- Customer Obligations
12.1 The Customer agrees to provide accurate, complete, and updated information when using Nawal Jewellery Trading LLC’Sservices.
12.2 The Customer is responsible for safeguarding their account credentials and ensuring no unauthorized access occurs.
12.3 Any violation of these terms by the Customer may result in legal action or the suspension of services.
- Contact and Updates
13.1 The Customer undertakes to notify Nawal Jewellery Trading LLC of any changes in name, address, email, and bank details.
13.2 Any notification or communication will be deemed received at the time of delivery or transmission, if sent to the last physical or email address provided by the Customer.
- Inheritance Procedures
In the case of succession, Nawal Jewellery Trading LLC relies solely on UAE law to establish the conformity of the documents. The steps to obtain additional documents are at the Customer’s expense if they are deemed insufficient by Nawal Jewellery Trading LLC.
An administrative fee of AED 900/hour (nine hundred AED per hour) may be charged to the Customer for additional compliance or inheritance procedures.
- Complete Contract
15.1 These General Terms and Conditions (GTC) constitute the full and complete agreement between Nawal Jewellery Trading LLC and the Customer. They supersede any prior proposals, correspondence, or other related documents unless mutually agreed upon in writing.
15.2 In the event of any discrepancies between the English version of these GTC and any translated versions, the English version shall prevail.
- Effectiveness and Amendments
16.1 If any part of this agreement is found to be legally invalid, it will not affect the validity of the remaining provisions. The invalid provision will be replaced with one that closely reflects its intended economic purpose.
16.2 Nawal Jewellery Trading LLC reserves the right to amend these GTC at any time. Updates will be reflected on the Website or App, and it is the Customer’s responsibility to periodically review this page for changes.
- Privacy and Data Security
17.1 To access services and place orders, the Customer must create an account with accurate personal information. Anonymized data may be retained if the account is deleted.
17.2 All personal information provided on the Website and App is handled with the highest level of confidentiality.
17.3 Customers can modify or remove their personal data (e.g., addresses, purchase history) via the “Profile” and “Address” sections.
17.4 Nawal Jewellery Trading LLC does not store credit card information; all transactions are processed securely by payment partners.
17.5 Persistent cookies are used to track transactions and improve user experience. Customers can manage cookies through browser settings.
17.6 Anonymous data collected through Google Analytics is used to improve Website organization and meet customer needs.
17.7 Nawal Jewellery Trading LLC only shares customer data with service providers who assist in sales or statistical analysis, and they are bound by data protection regulations.
- Regulating Law and Dispute Settlement
18.1 These General Terms and Conditions (GTC) and all transactions conducted with Nawal Jewellery Trading LLC are governed by and interpreted according to UAE law, excluding any principles of conflict of laws that would apply other legal systems.
18.2 Any disputes arising from or related to the relationship or transactions between NAWAL and the Customer shall fall under the exclusive jurisdiction of the courts in the Emirate of Dubai.
